Terms of Service

These Terms of Service ("Terms") govern your access to and use of foreclosureengine.com and the Foreclosure Engine platform (the "Platform") operated by Foreclosure Engine ("we," "us," "our"). By creating an account, claiming a State, or subscribing, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old and legally able to enter contracts in your jurisdiction to use the Platform. By using the Platform you represent that you meet these requirements and that the information you provide is accurate and current.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms, exhibit abusive behavior, or pose a security risk.

Accounts are issued to a single named user. Sharing credentials, reselling or redistributing access, and extracting Platform data for resale or for any competing product are strictly prohibited. The Platform and its underlying data compilations, valuations, scoring, and presentation are proprietary. You may not use the Platform — or permit any third party, service, or automated agent acting on your behalf to use the Platform — to train, fine-tune, evaluate, benchmark, ground, or otherwise develop any machine-learning model, large language model, embedding, index, retrieval system, or AI product, or to build any derivative dataset. Access is licensed for your own evaluation of investment opportunities and nothing more.

3. Subscriptions and Billing

Access to coverage data is sold as a monthly subscription billed per State. Pricing and any founding-member rates are displayed at the point of purchase and confirmed in your checkout summary. Subscriptions renew automatically each month at the displayed price until you cancel.

Payment is processed by Stripe. By providing a payment method, you authorize us to charge it for the subscriptions you claim, including recurring monthly charges, until you cancel.

If a payment fails, we may retry the charge, suspend access, or terminate the subscription. You remain responsible for any amounts owed for periods during which access was available.

4. Founding Rates

Founding rates are promotional pricing offered to early subscribers for specific States. A founding rate applies for the life of your continuous, paid subscription to that State. If you cancel or your subscription lapses, the founding rate is forfeited and future reactivations are billed at the then-current standard rate. Founding seats and inventory are limited and offered on a first-come, first-served basis.

5. Cancellation

You may cancel any subscription at any time from your account dashboard or by contacting us. Cancellation takes effect at the end of the current paid billing period; you retain access until then. We do not prorate partial months. See our Refund Policy for details on refunds.

6. Data and Accuracy

The Platform aggregates information from county records, public filings, assessor data, and other sources. We work to keep this data current and accurate, but source systems change, go offline, and contain errors outside our control. We make no warranty that listings, valuations, property characteristics, or any derived metrics (including estimated values, spreads, or urgency indicators) are complete, current, or fit for a particular purpose.

Nothing on the Platform is investment, legal, financial, or tax advice. You are solely responsible for independent verification of any property, lien, or opportunity before acting. Conduct your own due diligence and consult licensed professionals.

7. Acceptable Use

You agree not to:

  • Access the Platform through any automated means — including crawlers, scrapers, headless browsers, bots, or AI agents — or mirror, cache, or bulk-export Platform content, except via interfaces and rate limits we explicitly provide
  • Resell, sublicense, redistribute, publish, or otherwise make Platform data available to any third party, or use Platform data to build a competing product or derivative dataset
  • Use the Platform, or any content retrieved from it, to train, fine-tune, evaluate, benchmark, ground, or augment any machine-learning model, large language model, embedding, vector index, retrieval-augmented-generation system, or AI product, whether for internal use or for distribution
  • Reverse engineer, decompile, or attempt to extract source code
  • Circumvent rate limits, access controls, or usage restrictions
  • Use the Platform to harass, defraud, or unlawfully contact property owners or occupants
  • Upload or transmit malware, or interfere with the integrity of the Platform
  • Use the Platform in violation of applicable law, including fair-housing, consumer-protection, and telemarketing laws

8. Intellectual Property

The Platform, its software, interfaces, compilations of public data, and all associated content are owned by Foreclosure Engine and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Platform for your personal real-estate-investment use during your active subscription. All other rights are reserved.

9. Disclaimers

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, or that data will be accurate or current.

10. Limitation of Liability

To the maximum extent permitted by law, Foreclosure Engine and its officers, members, managers, employees, contractors, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any lost profits, lost revenue, lost data, lost goodwill, lost business opportunities, diminished deal value, investment losses, or damages measured by the value, cost, or anticipated return of any property or transaction, arising from or related to your use of the Platform, the accuracy or availability of any data, or any acts or omissions you take based on Platform content — even if we have been advised of the possibility of such damages, and regardless of the theory of liability (contract, tort, strict liability, warranty, statute, or otherwise).

Our total aggregate liability to you for all claims, in the aggregate, arising from or related to the Platform will not exceed the lesser of (a) the amounts you actually paid us for the Platform in the six months immediately preceding the event first giving rise to the claim or (b) one hundred dollars (US$100). Multiple claims do not enlarge this cap. This limitation is a material and bargained-for basis of these Terms and the pricing of the Platform, and it applies even if any remedy fails of its essential purpose.

Some jurisdictions do not allow certain exclusions or limitations. To the extent a limitation above is held unenforceable in your jurisdiction, the remaining limitations continue to apply to the fullest extent permitted, and our liability is limited to the minimum permitted by applicable law.

11. Indemnification

You will indemnify and hold Foreclosure Engine harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms, harms other users, or exposes us to legal risk. Sections that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, and indemnification.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from or related to the Platform will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted. Material changes will be noted by updating the "Last updated" date at the top of this page. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
